Juul Files for Appeal in the US Court After FDA Announced Ban in the US Market

On Friday, June 24, Juul Labs Inc. asked a federal appeals court to block its e-cigarette product ban temporarily. The ban was ordered by the US Food and Drug Administration or FDA.

Juul Appeals to Block Ban

According to Engadget, Juul's request came just 24 hours after the FDA told the vaping company that it had to remove all of its products from the US market.

The FDA stated that Juul could not provide enough evidence that its products did not impose potential risks when it applied to the agency so it could continue selling its vaping device, menthol-flavored, and tobacco-flavored nicotine pods.

However, Juul stated in a statement that what the FDA concluded does not make sense. The company is adamant that it provided sufficient research and evidence to address all of the issues raised by the health agency.

Joe Murillo, the vaping company's chief regulatory officer, said in a June 24 that Juul is currently exploring its options, including appealing the decision or engaging directly with the health agency.

Juul has filed an appeal with the US Court in Washington and asked for an emergency administrative stay until the company can file a motion for a stay pending review by June 27.

If the appeal is granted by the US Court, the vaping company and its retailers can keep selling its products in the US market until the US Court reviews the FDA's decision.

Juul claimed that the agency subjected it to unfair treatment compared with other e-cigarette companies.

According to the company's filing, the FDA's press release announcing its ruling on Juul products on June 23 was "strident and threatening.

The vaping company added that the agency's decision is arbitrary, capricious, and "lacks substantial evidence."

Juul's statement added that the US Court will give an immediate administrative stay is important to protect the company, its customers, and its partners.

According to CNBC, Juul also called out the FDA for imposing immediate removal of their products from the US market instead of giving them a transition period.

FDA Denies Application

TechTimes reported that on Thursday, June 23, the FDA had ordered the ban of Juul products in the US. The health agency reviewed Juul's premarket tobacco product applications and determined that some of the company's study findings had "conflicting and insufficient data."

The health agency said the data did not include the product's harmful chemicals and genotoxicity from the e-liquid pods.

The Wall Street Journal reported that the FDA banned several fruit-flavored e-cigarettes in the country after anti-smoking activists claimed that the said products appeal to teenagers.

Since 2020, the FDA has required all vaping companies to submit applications if they want to sell their products in the United States.

For the past two years, the health agency has banned fruit-flavored and mint-flavored juice pods that are used in vaping and e-cigarette products.

Tobacco-flavored and menthol-flavored products can still be sold in the country, but the companies need to prove that they don't pose any potential risks to consumers.
