President Joe Biden and his administration's immigration legacy may be shaped more by the ongoing immigration policy events (which includes the H-1B Visa rules) than by any of his long-term non-immigration reforms. However, the current administration is trying to improve the immigration policies, though there is nothing they can do to permanently solve America's immigration problems.So far, one good effort has been made to reduce the waiting period for H1B visas in 2022. In order to reduce wait times, the United States will stop conducting in-person interviews for H-1B and other visas until 2022.

According to the State Department, the authorization to skip the in-person interview for applicants renewing a visa in the same visa class within 48 months of the preceding visa's expiration has also been extended indefinitely.

Understanding H-1B Visa Processes For 2022

The H-1B visa is a nonimmigrant work visa that allows American companies to hire foreign workers for specialist jobs that require a bachelor's degree or higher. Jobs in IT, finance, engineering, architecture, and other fields are examples. You must register with USCIS electronically to enter a lottery if you are here to apply for an H-1B visa. To do so, you'll need to create an account with USCIS online. Even if you already have a USCIS account, you will need to create a new one for the registration process.

The completion of your application for a nonimmigrant visa in the United States through the CEAC is the first step. It takes roughly 90 minutes to finish this. After submitting your application, you can move on to the next steps, such as scheduling your interview.

Lastly, note that there will be an application fee increment which will allow premium visa processing. And up to three fee rules are expected. A USCIS "fee schedule" rule will certainly result in fee increases, though not as high as the level of increment the Trump administration intended.

To qualify for an H-1B visa, you should have the following:

  • An employment offer from a U.S. employer.
  • Proof of at least a bachelor's degree in the same discipline or its equivalent field that you are employed in.
  • The company that is employed must demonstrate that there aren't enough available and competent people to fill the position.

At some point in the application process, it is important to demonstrate that the post for which the foreigner is applying was offered to professionals living in the United States, but the US-based applicants lacked the necessary qualifications to perform the job. For applicants that can afford one, it's advisable to hire a lawyer for an H1B visa application.

It should be noted that before USCIS can act on it, the visa application must be sponsored by the employing company and the sponsor is not eligible to send multiple registrations for a single candidate.

Application Period

For this year's application, the initial registration period will begin on March 9 at noon Eastern Time (ET) and the registration period will only last for 14 days 9 for both representatives and registrants, it will close by March 25. You will not be eligible to apply for an H-1B visa if you do not register.

What is the H1B visa ?

The H-1B visa is one of many American work visas. This visa was created to allow American companies to recruit foreign workers who have high levels of skills that cannot be found on American soil.

For example, if you have a degree such as a Bachelor's, Master's or Doctorate, then the H1B visa is for you, it is the work visa that you can obtain to work in the United States thanks to your skills.

It is very popular because it is a real gateway to live and work in the United States and then obtain the Green Card if you meet certain criteria of the U.S. immigration laws.

In order to be eligible for this H1 B work visa there are certain rules to follow:

  • You must be a university graduate and have completed a higher education but also hold at least a Bachelor's degree.
  • You must be hired by the U.S. company for a skilled job that requires hiring an employee with at least a Bachelor's degree
  • Your employer must pay you the average wage for that type of job, basically they cannot underpay you because you are a foreign worker.

Generally the application fee for this type of visa as well as the lawyer's fee are paid by the company that will offer you a job, in order to facilitate the hiring process.

Finally, this visa is linked to your company, so you can not resign as you wish to work elsewhere, for that you must apply again with your new employer and start the process from zero again (application, fees, waiting time, approval...).
